Our government contracts practice covers a variety of issues spanning the procurement continuum, including transactions, litigation and disputes, and compliance. Government Contracts

We counsel and represent small (8(a), WOSB, SDVOSB, HUBZone, etc.) and mid-size government contractors on navigating the complex world of doing business with the federal government. Focused practice includes litigating bid protests before the Government Accountability Office (GAO), the U.S. Court of Federal Claims (COFC), the U.S Court of Appeals for the Federal Circuit, and Federal agencies (including FAA Office of Dispute Resolution for Acquisition), solicitation review, debriefing counseling, claims and disputes, teaming and joint venture issues, mentor-protégé agreements, and matters before the Small Business Administration (SBA), such as  size protests  and NAICS appeals.

Cybersecurity

We counsel and represent companies––both government contractor and commercial clients––on various cybersecurity issues including, data breach incident response, data protection, cyber planning, policies, cyber insurance, regulatory compliance (NIST SP 800-171, DFARS, CMMC, etc.), and privacy issues.

Outside General Counsel

We counsel and represent small and mid-size businesses and government contractors on a variety of issues, including contract drafting and negotiation (e.g., MSA, JV, subcontract, NDA, consulting, and service agreements), risk analysis, business disputes, company policies, corporate governance, business and cyber insurance, employment, and regulatory compliance.

Select Experience

  • Represented a small business IT services contractor in a bid protest appeal before the U.S. Court of Appeals for the Federal Circuit.

  • Represented and counseled numerous small businesses in bid protests before the U.S. Government Accountability Office.

  • Represented small business in an SBA size protest, which resulted in the SBA finding that the awardee was affiliated with a foreign multinational corporation.

  • Represented mid-size professional services contractor in bid protest before FAA ODRA.

  • Represented SDVOSB in a DoD agency-level bid protest.

  • Advised small business following a data breach, including FBI contact, client notification, and ransom demands.

  • Counseled and advised a growing cybersecurity consultancy firm in negotiating/drafting a variety of contracts, including master services agreements (incident response, security audit, pen testing), strategic alliance agreements, and vendor agreements.

  • Counseled and advised clients on compliance with federal procurement laws, Federal Acquisition Regulation (FAR), Defense Federal Acquisition Regulation Supplement (DFARS), and RFP/RFQ requirements.

  • Counseled and advised clients on various cybersecurity issues, including, cyber insurance, contract drafting/review, data protection, data breach, and privacy issues.

  • Outside general counsel to small and mid-sized businesses.
